Terms of Derivative Works (Fan Creations)
I. Open Attitude towards Derivative Works
hitorino maintains an open stance toward community-created derivative works (fan creations). Creators are permitted to freely produce derivative content based on any published or uploaded video content involving our publicly available virtual idols/game characters, as well as the video game "The Meridian under the Heaven: Valhalla", without the need for prior authorization.
Such permitted derivative works include (but are not limited to):
- Gameplay commentary videos ("Let's Play")
- Live-streaming gameplay sessions
- Parody, comedic, or commentary videos related to virtual idols
Creators retain the rights to all income generated from these creations (e.g., revenue sharing on platforms such as Bilibili, advertising revenue on YouTube).
II. Basic Requirements for Derivative Works
- Compliance with Platform Rules and Legal Regulations
- All derivative works must strictly adhere to the guidelines and user agreements of the publishing platforms.
- Content must not violate the relevant platform's terms or the laws and regulations of the country or region in question. Personal attacks, infringement of others’ rights or interests, or harm to others' reputation are strictly prohibited in any form.
- Avoidance of Sensitive Topics
- During the creative process, creators must refrain from engaging with sensitive topics such as politics, religion, or ideological issues, thus ensuring content remains neutral and safe.
- Respect for Originality and Avoidance of Plagiarism
- Derivative creations must involve reasonable adaptation or reinterpretation, explicitly avoiding direct plagiarism or excessive reliance on original elements.
- Creators should respect the original creator’s work and, where appropriate, clearly indicate original authorship within their content.
- Intellectual Property and Trademark Restrictions
- Creators are strictly prohibited from registering trademarks, copyrights, patents, or other intellectual property rights involving graphics, text, music, or other materials belonging to the hitorino community and its affiliated members in any country or region.
- Clear Attribution
- When publishing derivative works, clearly indicate the involved virtual idol characters and their affiliation with the hitorino community in the titles, descriptions, or relevant informational sections, allowing audiences to easily recognize and categorize content.
III. Terms for Open Merchandise Use and Trade
- Scope of CC BY-NC License
- Most open-access merchandise from hitorino (such as 3D printable models, select cushion images, wallpapers, etc.) follows the Creative Commons Attribution-NonCommercial (CC BY-NC) licensing. Under compliance with these terms, users are free to distribute, excerpt, remix, or otherwise create derivative content, provided they credit the original author (hitorino interactive) and refrain from commercial uses.
- Physical Merchandise Sales Regulations
- Considering some fans might lack access or conditions required for 3D printing equipment, we permit and actively encourage fans within the hitorino community to reasonably trade official physical merchandise among themselves.
- When conducting sales, fans should carefully consider transportation, material, and labor costs to ensure fair and transparent pricing and transactions.
Through these terms, we aim to provide creators and fans with an open, respectful, lawful, compliant, and safe environment for derivative creativity and community interactions.
